Is my car insurance company ripping me off???

I was in an accident two weeks ago. It inolved 5 cars. However, my insurance company said I shouldn't be at fault because I was rear-ended. Anyway, they totaled my car the day after the accident, and gave me a price they were willing to offer. They gave me 5 days of a rental car to find a new car. My 5 days for my rental car lapsed without receiving my check for my totaled car. I contacted my insurance agent and she said they were putting liability on the car that hit me. This other car is also insured by my same insurance company. So my agent was rather rude when I asked when I could expect my check; she stated "We are putting this through to the other car's agent so I don't know when you will get your check." So in the meantime I have had to spend $200 to keep my rental past the 5 days. So as I see it, my insurance company "stole" my car by totaling it, and then stopping payment on my rental car without sending me a check to buy a new one. Thank you for all of your help. If I file it under my insurance to get the check (minus the deductible) faster, will my rates go up even though the accident wasn't my fault? About the title: I still have the title because they haven't given me the check, but they took it to a junk yard already.

  1. Call your agent and have them subro to get you an extension on the rental. If the agent was rude...find a new agent. She must make enough in commissions to warrant ticking off her clients.
  2. your insurance company, your policy, owes to extend your rental. you pay for this coverage. you need to call your adjuster and ask about the status of the check. was it written? when? when was it sent? what amount? being that there were 5 cars involved, you will probably have to file under your policy because there almost surely going to be an excess issue here-this is where the at fault parties property damage limits are not sufficient to pay for damages to all parties involved. remember, you pay a premium for rental car coverage, technically, you can stay in that rental for 30 days and they would have to pay for it.

  4. Don't call your agent, call your adjuster. Tell them you have not received your check & ask if they issued it. If they have not yet issued you a check, they should still be paying for your rental. Tell them that since you have not gotten your check, you expect them to continue paying for the rental, until which time you receive your check. Also, you should have the rental for a few days AFTER you get your check to give you time to purchase a vehicle (I would say they should reasonably give you 2 to 3 days). Tell them you expect the $200 paid too. If you do not get satisfaction from your adjuster, go to their supervisor & then manager & up the ladder until you get your rental paid. They should be filing this under your collision coverage (even though you will be getting the totalled vehicle check less your deductible) because it is quicker. They can send you your deductible back once the other party's adjuster has accepted the liability (this can take a week or two even for cut & dried liability because they are obligated to fully investigate all claims & speak to the other party, etc).
  5. The insurance company (either through the liability policy or your your policy) does not owe you a rental car until they give you a check. They owe you a rental until they make a reasonable offer. From your question, it sounds like they provided the rental 5 days beyond the date of the offer. That is fair. They are not ripping you off and have actually gone beyond their legal obligation to you.
