If my auto insurance gave me false information can I sue them?
My car was broken into and this resulted in a broken window. I filed a report with police and then filed a claim with my auto insurance. I spent all day literally (8:00am-5:00pm) dealing with my insurance company. They kept telling me that they couldnt find anyone who could get me in to get my window fixed. I finally found a auto glass shop that could repair my window and was on the list of shops with my insurance company. Then, my insurance company said that the local shop would not "match their price".We were having tornado warnings in my area that night so I wanted to get the window fixed that day. They told me the best they could do was to suggeest using a trashbag and tape and cover it up the best I could. I found out today from this auto glass company that my insurance lied to me just because they didnt want to pay the claim. Can I sue my insurance company for giving me false information?

- I don't think this constitutes suing, but I would complain to the head office and I would switch companies or at least offices.
- Malpractice isn't used just for medical claims. In today's world, you can pretty much sue anyone for anything. The catch in this situation will be getting the repair shop to say under oath that the insurance company lied because they didn't want to pay the claim since they could lose the privilege of being on the insurance company's preferred list which could affect their business. Good luck!
- What exactly would be the grounds for your "suit". How were you "damaged"? What kind of compensation are you looking for? I really doubt that your insurance company lied to you, and did not want to pay your claim. If you have the proper coverage for this loss, comprehensive and/or glass coverage, there is no reason why your insurance company would not cover you. Perhaps the damage was below your deductible if it applied. Consider contacting a supervisor if you are not happy with how your claim was handled. But suing, that is just plain silly.
- How were you harmed? I don't think you'd have much of a claim here. Your auto insurance company is legally bound to pay as stated in your policy. If you paid for comprehensive coverage, they have to repair the window.
- Did you speak to your agent or a CSR(Customer Service Rep)? If you spoke to a CSR, when you go back be sure to ask to speak to an agent or a supervisor. If you spoke to an agent, ask to speak to a supervisor.
