Car Insurance Write Off question. Whats refering back to the insurance as a stale mate when we refused offer?
I had an accident a the end of december and the other driver admitted liability, the car has been written off and we had an offer of £2000 from the insurance company which I flat turned down as to get the same make, model and year etc would cost us (the lowest found £2695). I sent in all the information and a covering letter and they have now offered £2200...and they said "if you do not accept this offer it will go down as a stale mate and be returned to the insurance company"...what the chuff does this mean? I thought they were the insurance company? Any insurance guru's out there care to enlighten me? Thanks ok thanks for the answers so far. I cant find any link between my isurance compnay Royal Sun Alliance and His Equity Red Star..... also from what I can gather, My insurance company refer oit to some company called ETWB who arrange the offer, I dont really know how this works, whether my insurance company will get a settlement, pay me and then get it back from his insurance. I would have thought it would be hios insurance that pays me direct Thank you. We already have a hire car that is being paid for by the other parties insurance company so they wont be best pleased they are having to pay for this. We have a supervisor calling us back in the morning to discuss it , the normal chappie didn't even know which insurance company he would be refering it back to!

- It means take it or leave it. If you refuse it, the offer is withdrawn and they are done with you. Now it will be up to you to work either with your own insurance or the court system to open it back up for arbitration.
- Tell them that unless they improve there offer you will take them to court and will also be claiming for lost time and replacement car rental until the case is settled, they are bluffing you don't bite on it, if the accident wasn't your fault you are entitled to recover all your losses. This generally happens when both you and the other driver are insured by companies within the same group. Google both the companies and see if they have any connection, if they do then don't rely on your company to put up much of a fight for you, just threaten them with court action. ETWB is a loss adjusting company, they are employed buy insurance companies to basically settle the claim for the smallest amount possible, insurance companies used to have there own loss adjusters, but now most of them just sub contract this work out. don't be put off buy these people refusing to up the offer they have already made. if they say they will pass it back to the insurance company then tell them to do that, and make sure you point out that you will be claiming for any further cost you incur in the mean time. The lower the settlement they can get you to except the higher the commission they receive for doing so. I would tell them that if they don't improve your offer to an acceptable level, that you want it referred back to the insurance company, so as not to be wasting any further time with a third party. - It could be that the insurance company has outsourced the claims process to a third party claims operation. This happens a lot. It could also mean that a claims adjuster is being used by the insurance company to process claims. As far as you are concerned - treat them as the insurance company (as legally they are an agent of the co ) and ask about the complaints procedure - which they a re required to explain to you where there is a disagreement. They may have already given you this information but you may not have recognised it for what it is. It is important to make a written complaint as any referral to,say, an ombudsman is dependant on you making one. They often try to wear you down but don't be disheartened and perseverence on your part often pays off. Finally ask them to give you the facts which they have used to arrive at the £2,200. It should not be a matter of their opinion.
