What should I do about my car insurance company?
My car was in an accident and my boyfriend was the driver ..there were no injuries only damage to both cars and nobody was cited for the accident.Anyways, He was not on my insurance and we live together. I had given my insurance company and the other insurance company a statement over the phone and today, about a month later, I get a letter saying I owe his insurance about$3700.00. I called the insurance company and they said that MY insurance person said that they dropped my claim because I was "un-cooperative with their investigation" I have not heard from my insurance lady since the statement! I can see not covering it because he was not on my insurance but how am I being uncooperative? I was just curious if anyone has heard of this. The insurance guy for the other driver thought it sounded strange to him. He usually does not drive my car but it was 4:30 in the morning and our baby was running a fever so he went to get medicine. his truck had a flat. He was hit by a driver who ran a light but the cop could not prove who was at fault. My van is only worth about $800.00 so I did not have it fixed .....yet!!!

- You should call and request a meeting to talk about it.
- Send your insurance company a certified letter, return receipt requested, demanding that they show cause why they should deny coverage. If they don't shape up, it's off to small claims court.
- Call your insurance company & ask for a supervisor. Explain the situation. And remember, you catch more flies with honey then with vinegar. Don't get nasty unless you begin to think they're intentionally screwing you. In that case, get names & dates & contact your state's "State Corporation Commission" & the insurance commissioner.
- I don't know about the whole uncooperative bit, that does sound strange to me... That being said, if he's not on your insurance, he shouldn't have been driving your car. Your insurance is under NO obligation to pay for an accident that involved a driver not covered on a policy you have. They could have easily dropped your claim because there wasn't a covered driver involved in this accident under their policy, Your car is insured under YOUR name, not his.
- Very hard for Ins co to deny a claim based on non-cooperation. Especially if you did cooperate and give them a statement. Did your boyfriend give them a statement too? they would want to talk to both of you. Sounds like he is what we consider a "permissive user". pull out your policy and see what the defination of an "Insured" is. check Part A of your policy. Technically, he should be listed on your policy if he lives with you-you guys can probably get a multi car discount if he owns a car, and you combine policies. but it's unusual for it not to be covered if you told him to take the car and gave him the keys. Anyway, after you check your policy and see what is says about who qualifies as an insured,call your insurance company and ask for a Mgr. usually denials on claims have to go through Mgt, so chances are someone up high has already looked at the file. One of the previous answers said to be nice--definately will help you. Worst case senario--there was some misunderstanding between you/boyfriend and the adjuster and once you make contact w/ a mgr and explain that, they can reopen the file for their investigation to continue. If you dont get results there, get in touch with your state insurance dept, keep in touch w/ the other insurance company too, to let them know that you are trying to work it out with your insurance company. check your state insurance departments website--they usually have a list of FAQ's for consumers, sometimes address stuff like this.
- Most insurance companies require that you declare and have rate all license drivers in household. I never had my wife on my policy and I was never on hers but I undestood the problems. You need to call the adjuster from your company and get things straight or speak to the supervisor.
- Call your insurance company! Ask to speak to the claims supervisor. Ask that person to explain to you, how you were un-cooperative, and ask them to reopen the claim. I have only 1 claim that the person was un-cooperative, so I was stuck in the middle. I talked for both parties, we got the truck fixed. They must have found your boyfriend at fault or the other company would not be looking for payment from you. Ask your company to make sure. They can refuse to pay the claim, because he should have been listed on your policy. But sometimes companies will pay a claim that they are legally obligated to. If they do refuse, then make a payment arrangement with the other company. Don't freak out, they will be glad to work with you. This is one of reasons to have everybody listed that drives your car, but we don't think things like this will happen. Please give your company a call, don't talk to your adjustor, by-pass them and get the supervisor. They should be aware that their adjustor isn't doing their job. I am sorry this happened, most companies don't do this. Like I said, I talked for my client to the insurance company, and the insurance company had me talk for them to the lady that was just being so unreasonable. But I consider it part of my job. If you don't want to call the supervisor, call your agent and get them to look into it. That's part of their job. I know I do alot work on the phone, just finding out what's up. - call your agent and get an answer there, you pay for your insurance so you are entitled an answer. go ever your ladies head and call corporate, try callin another agent from same complany and seein what they say....
